Introduction

The upcoming criminal trial of Sam Bankman-Fried, a prominent figure in the cryptocurrency industry, faces a hurdle as prosecutors request permission to have a Ukraine-based FTX customer testify remotely. Bankman-Fried’s defense team opposes this request.

The Request for Remote Testimony

In a recent court filing, prosecutors asked Judge Lewis Kaplan for approval to include witness testimony via a two-way video teleconference. However, Bankman-Fried’s defense team has expressed their lack of consent for this arrangement.

The Ukraine-based FTX Customer

The individual in question, referred to as “FTX Customer-1” by the prosecutors, is a young male residing in Ukraine. He suffered significant financial losses when Russia invaded Ukraine in 2022. Unfortunately, due to Ukraine’s war-time law, he is unable to leave the country as it prohibits men deemed fit for combat from traveling.

Challenges of Testimony

If the FTX customer were to testify, he would need to secure a special exemption from Ukrainian officials to exit the country. However, even with this exemption, the travel time for the customer is estimated to be around three days each way, involving a complicated route through an ongoing war zone.

Prosecutors’ Perspective

The federal prosecutors argue that testimony from international witnesses, such as the FTX customer, is crucial in understanding the global nature and influence of the FTX crypto-exchange. They highlight the complexities of coordinating international authorizations and travel arrangements for witnesses dispersed across the world.

Comments from Involved Parties

Both the spokesperson for the prosecutors and Bankman-Fried’s media representative declined to comment on the matter.

Bankman-Fried’s Trial and Bail Revocation

Sam Bankman-Fried has been awaiting his trial in a New York jail after his bail was revoked over allegations of witness tampering. The trial is scheduled to begin soon and is expected to last until November 9.
