Digital Millennium Copyright Act (DMCA) Notice and Takedown Procedure

At Habertusba (https://www.habertusba.com), we respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond promptly to valid notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA).

Policy Overview

  • All users of www.habertusba.com are expected to comply with applicable copyright laws.

  • Upon receiving proper notification of claimed copyright infringement, we may:

    • Remove or disable access to the allegedly infringing material.

    • Terminate access for repeat infringers.

  • If we remove or disable content in response to a DMCA notice, we will attempt in good faith to contact the content creator so they may file a counter-notification under Sections 512(g)(2) and (3) of the DMCA.

We may also maintain a record of infringement notices and actions taken.


Filing a DMCA Notice of Copyright Infringement

Submitting false claims may result in liability for damages (including legal fees). If you are unsure whether your material is protected or if its use is considered fair use, please seek legal advice before filing.

To submit a notice, your written communication must include the following information:

  2. A statement declaring:
    “I am the copyright owner or an agent authorized to act on behalf of the copyright owner of the following copyrighted material.”

  3. A description of the copyrighted work that you claim has been infringed (for example, title, author, or a direct link to the original content).

  4. Identification of the infringing material on our site, including the exact URL where it appears, so we can locate it.

  5. A statement, made under penalty of perjury, that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.

  6. Your physical or electronic signature.


Counter-Notification

If your content has been removed due to a DMCA notice and you believe this removal was a mistake or misidentification, you may file a counter-notice. Your counter-notice must include:

  1. Your full name, mailing address, telephone number, and email address.

  2. Identification of the removed material and its location before removal.

  3. A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification.

  4. A statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., to the jurisdiction of a court where we may be found).

  5. Your physical or electronic signature.

If a valid counter-notification is received, we may restore the material unless the original complainant seeks a court order to prevent restoration.
