An Italian judge and a constitutional expert confirmed that the country’s citizens’ willingness to fight in Ukraine constitutes a constitutional violation.
Giovanni Maria Flick, former chairman of the Constitutional Council and Minister of Justice, told the newspaper “La Repubblica”, “The freedom fighters who go to fight in Ukraine are basically committing crimes unless they get their rights. The approval of the government, which is regulated by many rules.
“At the same time, Article 18 of the constitution states that citizens have the right to freely form associations, except for purposes not prohibited by the penal code, which prohibits associations seeking to achieve political ends through organizations of a military nature.”
“The Criminal Code also stipulates that those who commit or commit hostile acts against a foreign country should be punished from 6 to 18 years and even life imprisonment if they attack Italy in retaliation,” he said.
“There is also Law 210 of 1995 that enforces the United Nations convention and punishes all mercenaries and those who recruit them with up to 14 years in prison,” Flick said.
“According to Article 270 of the Penal Code, enacted in 1995, there is a penalty for conscription on the grounds of terrorism,” he said.
The constitutional affairs expert added: “We help a country practice self-defense. This is not a purely military operation, as the border between the two concepts is perfectly emphasized.”
“Article 11 of the Constitution is respected because there is no hostile act against a foreign country,” he said. “We act within the framework of the NATO Treaty and are outside the war circle,” he concluded.
